Preliminary ITC decision clears Motorola of infringing Apple patents

It seems that lawsuits can rumble on for ever.

Yet, in the case of three patents that Apple took to the US International Trade Commission (ITC) accusing Motorola Mobility of infringement, a judge has published a preliminary notice finding there was 'no violation'.

Patent that

The patents related to how an operating system works and two concerning multi-touch surfaces; the latter something Apple is trying to enforce in many of its international lawsuits against Motorola, HTC and Samsung amongst others.

"We are pleased with today's favourable outcome for Motorola Mobility," said Scott Offer, senior vice president and general counsel of Motorola Mobility.

"Motorola Mobility has worked hard over the years to develop technology and build an industry-leading intellectual property portfolio. We are proud to leverage this broad and deep portfolio to create differentiated innovations that enhance the user experience."

Never-ending story

Of course, this isn't the end of the matter, with the final decision in the case due from a six-person body is due on 14 May 2012.

Motorola also has a counter-suit with Apple pending at the ITC. Its preliminary hearing is due on 23 April.
