Lawsuits are flying about the mobile gaming world like moths at the moment, though most of it seems to be centred around hardware disputes. Bejeweled publisher PopCap has also been caught up in legal action, however, after developer MumboJumbo successfully sued it in Dallas courts for $4.6 million.
MumboJumbo claims PopCap breached a contract it had entered into for the former to distribute games in the US, which PopCap then marketed on its own. It went on to allege that PopCap had also, "severely damaged the business relationship between MumboJumbo and a key retailer."
A Dallas jury voted in favour of MumboJumbo after a 12 day trial in which PopCap was found to have, "committed fraud and tortious interference".
"The law allows you to do plenty of things to be successful in business," said attorney Marty Rose of Dallas-based Rose Walker, who represents MumboJumbo. "However, it does not allow you to commit fraud or interfere with a company's business relationships. The jury's verdict is a clear signal that this type of business conduct is not going to be tolerated."
PopCap isn't taking the accusations laying down, however, and has already entered into an appeal.
PopCap continues to believe that it did nothing wrong in this case, and will vigorously pursue its claims and defend itself through the appeals process, Vice president of PopCap public relations, Garth Chouteau, tells Edge.
